Privacy Policy

This Privacy Policy describes how PocketVolt LLC, doing business as Canned (“Canned,” “we,” “us,” or “our”), handles personal information collected through shopcanned.com(the “Site”) and our related services (the “Services”). By using the Services, you agree to this policy. If you don’t agree, please don’t use the Services.

1. Information we collect

We collect the following categories of personal information, depending on how you interact with us:

• Contact and lead information — your email address, and optionally your café or brand name and any details you choose to share, when you use tools on the Site (such as a pricing/ROI calculator or a design preview), sign up for our newsletter, save a design, or respond to an on-site prompt.
• Account information — the email and login credentials used to create and access your account (authentication is handled by a third-party provider).
• Designs and uploads — logos, artwork, colors, text, and layout choices you upload to design your cans, along with the print files we generate from them.
• Order and subscription information — the products you buy, order and billing history, Canned Club subscription details, and shipping and fulfillment information. Machine orders also include a delivery phone number, which we use to schedule the freight drop-off and share with our fulfillment and carrier partners for that purpose.
• Payment information— processed by our third-party payment processor. We receive limited details such as a payment confirmation, the card type and last few digits, and a customer identifier; we don’t collect or store full payment-card numbers.
• Usage, device, and cookie information — collected automatically when you visit the Site, including IP address, device and browser type, pages viewed, referring pages, and interactions, gathered through cookies and similar technologies (see Section 3).

Under some state privacy laws, these correspond to statutory categories such as identifiers, commercial information, internet or other network activity, and visual information (your uploaded artwork), along with account log-in credentials. We collect this information directly from you, automatically through your use of the Site, and from the service providers who help us operate the Services.

2. How we use your information

We use personal information to:

• process, manufacture, ship, and support your orders, and provide the Machine, cans, and Canned Club Services;
• create and manage your account, authenticate you, and respond to your requests and support inquiries;
• send transactional messages (order, shipping, billing, subscription, and account notices);
• send marketing and promotional emails, which you can opt out of at any time;
• personalize your experience and generate design previews and mockups;
• measure, analyze, and improve the Site, our products, and our marketing — including through analytics and advertising technologies;
• show you relevant ads and measure their performance on our Site and on third-party platforms;
• detect, prevent, and investigate fraud, abuse, and security incidents; and
• comply with our legal obligations and enforce our Terms of Service.

3. Cookies and tracking technologies

We and our analytics and advertising partners use cookies, pixels, tags, and similar technologies to run the Site and to collect the usage and device information described above — including in real time as you interact with the Site. We use them for four broad purposes:

• Strictly necessary — to operate the Site, keep you logged in, maintain your cart, and secure the Services.
• Functional — to remember your preferences and settings.
• Analytics — to understand how visitors find and use the Site so we can improve it.
• Advertising — to measure our marketing and show you relevant ads on our Site and on other platforms, which may involve sharing online identifiers and activity data with advertising partners.

You can control cookies through your browser settings and, where available, through our on-site cookie or “Your Privacy Choices” controls. Disabling some cookies may affect how the Site works. We also honor recognized opt-out preference signals, including Global Privacy Control (GPC), which we treat as a request to opt the sending browser or device out of the “sale” or “sharing” of personal information. See Section 5.

4. How we share your information

We don’t sell your personal information for money. We share personal information only as described here:

• With service providers that help us run the business and act on our behalf under contract — including providers of payment processing and subscription billing; email, communications, and marketing delivery; account authentication; design and image processing; website hosting, cloud storage, and databases; analytics; fraud prevention; and customer support.
• With manufacturing, print, shipping, and fulfillment partners — the factory and print partners that produce your blank and custom cans, and the carriers and third-party logistics (3PL) partners that warehouse, pack, and ship your orders.
• With advertising and analytics partners— to measure our marketing and deliver relevant ads. Some of this activity may be considered a “sale” or “sharing” of personal information under certain state laws, even though no money changes hands. You can opt out at any time (see Sections 3 and 5).
• For legal and safety reasons — to comply with law, respond to lawful requests, protect the rights, property, and safety of Canned and others, and enforce our agreements.
• In a business transfer — in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

In the preceding 12 months, we have disclosed the categories of personal information described in Section 1 to these categories of recipients for the business purposes described in this policy, and we have not sold personal information for monetary consideration. We can identify the specific third parties involved where required by applicable law.

5. Your choices and rights

Marketing. You can unsubscribe from marketing emails at any time using the link in any such email, or by emailing info@shopcanned.com. We’ll still send you transactional messages about your orders, subscription, and account.

Cookies and ad choices.You can manage cookies through your browser and our on-site controls, opt out of advertising cookies through our “Your Privacy Choices” controls, and send a Global Privacy Control (GPC) signal, which we honor.

State privacy rights. Depending on where you live, you may have some or all of the following rights under laws such as the California Consumer Privacy Act (as amended by the CPRA) and other U.S. state privacy laws:

• to know or access the personal information we hold about you, and how we collect, use, and share it;
• to receive a portable copy of your personal information;
• to correct inaccurate personal information;
• to request deletion of your personal information;
• to opt out of the “sale” or “sharing” of personal information and of targeted advertising;
• to limit the use and disclosure of any sensitive personal information;
• to opt out of certain profiling; and
• to not receive discriminatory treatment for exercising these rights.

How to exercise your rights. Email info@shopcanned.com(or use any privacy request form we provide on the Site). We’ll take reasonable steps to verify your identity before responding, and we’ll respond within the time required by applicable law (generally within 45 days, with an extension where permitted). You may use an authorized agent to submit a request on your behalf, subject to verification. If we deny your request, you may appeal by replying to our decision, and we’ll respond as required by law.

6. Sensitive personal information

We don’t seek to collect sensitive personal information to infer characteristics about you. To the extent account log-in credentials or payment details are treated as “sensitive” under some laws, we use them only to provide, secure, and support the Services — a purpose those laws permit — and for no other purpose.

7. Data retention

We keep personal information for as long as needed to provide the Services and fulfill the purposes described in this policy, and then for as long as reasonably necessary to:

• maintain your account and subscription while they’re active;
• keep order, tax, and accounting records for the periods required by law (typically several years after a transaction);
• retain your uploaded designs and print files while your account is active or as needed to reproduce reorders;
• keep marketing contact information until you opt out; and
• resolve disputes, enforce our agreements, and meet our legal obligations.

When we no longer need personal information, we delete, de-identify, or securely archive it.

8. Data security

We use reasonable technical and organizational measures designed to protect personal information against loss, misuse, and unauthorized access. No method of transmission or storage is completely secure, so we can’t guarantee absolute security. Please keep your account credentials confidential.

9. Children’s privacy

The Services are intended for businesses and aren’t directed to children. We don’t knowingly collect personal information from children under 13, and we don’t knowingly sell or share the personal information of anyone under 16. If you believe a child has provided us personal information, contact us and we’ll delete it.

10. Where your information is processed

We operate in the United States, and your personal information is stored and processed there. If you access the Services from outside the United States, you do so on your own initiative and consent to processing in the United States.

11. Third-party links

The Site may link to third-party websites or services we don’t control. This policy doesn’t apply to them, and we’re not responsible for their privacy practices. Review their policies before providing personal information.

12. Changes to this policy

We may update this policy from time to time. The “Last updated” date above reflects the current version, and material changes take effect when posted. We review and, as needed, refresh this policy at least every 12 months.
